These Terms and Conditions ("Terms") apply to your use of Lucy, the AI agent developed and provided by Everyday ("we", "us", or "our"). By subscribing to or using Lucy, you agree to these Terms.

  1. SaaS Services and Support

1.1 Provision of Services
Everyday provides access to Lucy — a software-as-a-service (SaaS) AI agent designed to automate business tasks. By registering, you (“Customer”) agree to these Terms. We reserve the right to refuse or revoke account access at our sole discretion.

1.2 Technical Support
Support is offered during business hours via email and web-based channels. While we strive for availability, service levels are not guaranteed.

  1. Restrictions and Responsibilities

2.1 Restrictions on Use
You agree not to:

  • Reverse-engineer, disassemble, or decompile Lucy or any part of our platform

  • Modify, copy, or create derivative works from the Services

  • Resell, sub-license, or use the Services to provide services to third parties

  • Remove any proprietary notices or legal labels

2.2 Compliance with Laws and Acceptable Use
You agree to use Lucy in accordance with applicable laws and regulations. You must not use the service to transmit unlawful, offensive, or infringing content. We may suspend your account if we believe your usage violates these standards.

2.3 Customer Responsibilities
You are responsible for:

  • Maintaining your access credentials securely

  • All activity under your account (whether authorised or not)

  • Any necessary hardware, internet access, or integrations required to use the Services

  1. Confidentiality and Ownership

3.1 Confidentiality
Both parties agree to treat any shared business, financial, or technical information as confidential and not to disclose it except where legally required.

3.2 Data Ownership
You retain all rights to your own business data.
We retain all rights, title, and interest in the Lucy platform and underlying software.
We may use anonymised or aggregated usage data to improve Lucy.

  1. Payment and Billing

4.1 Fees
All applicable fees are displayed at checkout or agreed in writing. We reserve the right to adjust pricing with 30 days’ notice. Subscriptions auto-renew unless cancelled.

4.2 Invoicing and Late Payment
Payment is required in advance or as otherwise agreed. Late payments may incur fees, and non-payment may lead to account suspension or termination.

4.3 90-Day Money-Back Guarantee
We offer a 90-day money-back guarantee for new customers. Here's how it works:

  • You may request a full refund within 90 calendar days of starting your subscription

  • To qualify, you must use Lucy in at least 250 unique lead interactions during this period

  • If Lucy does not help generate at least 10 qualified sales calls in that time, you're eligible for a full refund

  • Refund requests must be submitted in writing to hello@hirelucy.ai before the end of the 90-day window

  • We reserve the right to verify usage data to confirm eligibility
    If these conditions are met, your refund will be processed — no questions asked.

  1. Term and Termination

5.1 Term
These Terms remain in effect until your subscription is cancelled or terminated.

5.2 Termination
Either party may terminate this agreement with written notice. We may terminate immediately for non-payment or breach of these Terms.

5.3 Post-Termination
Upon termination:

  • Access to Lucy will cease

  • Any outstanding fees remain payable

  • No refunds will be issued for used or partial periods outside the 90-day guarantee

  1. Fair Use Policy

To maintain high performance and equitable service across all clients, Lucy operates under a Fair Use Policy.

All subscription plans include generous usage allowances. However, to ensure sustainable service delivery and manage infrastructure demands, we reserve the right to monitor account activity and take action if usage:

  • Exceeds reasonable levels of AI agent interactions

  • Results in substantially higher-than-average token consumption

  • Negatively impacts the availability or performance of the service for other users

Reasonable use is defined as:

  • Up to 3 million tokens and/or 1,000 AI-led conversations per month on monthly plans

  • Or up to 40 million tokens and 8,000 conversations per year for annual plans

These thresholds are designed to support robust business operations. If a customer exceeds these limits, we may:

  • Recommend an upgrade to a higher usage tier

  • Suggest optimisations to workflows or integrations

  • Or, in rare cases, throttle or limit specific functions to maintain system performance

This policy ensures Lucy remains fast, reliable, and fair for all users.

  1. Warranty Disclaimer

Lucy is provided “as is” and “as available.” We do not guarantee uninterrupted access or that the Services will be error-free. No warranty is provided for merchantability, fitness for purpose, or non-infringement.

  1. Limitation of Liability

To the maximum extent permitted by law, Everyday shall not be liable for:

  • Any indirect, special, or consequential losses

  • Any data loss, downtime, or business interruption

  • Damages exceeding the total fees paid in the 12 months prior to the claim

  1. Miscellaneous

9.1 Severability
If any clause is found to be unenforceable, the remainder of the Terms shall remain in force.

9.2 Assignment
You may not transfer your rights under these Terms without written consent. We may transfer or assign our rights at any time.

9.3 Entire Agreement
These Terms, along with our Privacy Policy, constitute the full agreement between you and Everyday.

9.4 Relationship
Nothing here creates a partnership, joint venture, or employment relationship.

9.5 Notices
All legal notices must be sent in writing to hello@hirelucy.ai or via registered mail to the address provided on our contact page.

9.6 Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be handled by the courts of England and Wales.
